Terms of Use

Please read these Terms of Use carefully before accessing or using any part of the Nibetaus platform available at nibetaus.com. By accessing or using the platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the platform.

1. Acceptance of Terms

These Terms of Use constitute a legally binding agreement between you and Nibetaus governing your access to and use of the website, online workshops, interactive exercises, and all related services (collectively, the "Platform"). Your continued use of the Platform following any update to these Terms constitutes acceptance of those changes.

2. Eligibility

You must be at least 18 years of age to create an account and use the Platform independently. If you are under 18, you may only use the Platform with the involvement and consent of a parent or legal guardian. By using the Platform, you represent and warrant that you meet the applicable eligibility requirements.

3.1 Account Creation

To access certain features of the Platform, you may be required to register for an account. You agree to provide accurate, current, and complete information during registration and to keep that information up to date.

You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at support@nibetaus.com if you suspect any unauthorised access to your account. We are not liable for any loss resulting from unauthorised use of your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account at our sole discretion if we determine that you have violated these Terms or engaged in conduct harmful to the Platform, other users, or Nibetaus.

The Platform is provided for personal, non-commercial educational purposes. You may access and use the content, workshops, and tools solely for developing your own skills and knowledge in accordance with these Terms.

5.1 Ownership

All content available on the Platform, including but not limited to workshop materials, exercises, text, graphics, videos, audio, logos, and software, is the exclusive property of Nibetaus or its licensors and is protected by applicable intellectual property laws.

5.2 Limited Licence

Subject to your compliance with these Terms, Nibetaus grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform content solely for your personal educational purposes. This licence does not include any right to sublicense, modify, adapt, translate, or create derivative works based on the content.

5.3 User Submissions

If you submit any content, feedback, ideas, or materials to the Platform, you grant Nibetaus a worldwide, royalty-free, perpetual, irrevocable licence to use, reproduce, modify, and distribute such submissions for the purpose of operating and improving the Platform. You represent that you have all necessary rights to grant this licence.

6. Payments and Subscriptions

6.1 Fees

Certain features or workshops on the Platform may require payment. All applicable fees will be clearly disclosed prior to purchase. By completing a purchase, you authorise Nibetaus to charge the specified amount using your selected payment method.

6.2 Refunds

Refund eligibility is determined on a case-by-case basis in accordance with our refund policy. To request a refund, please contact us at support@nibetaus.com. We reserve the right to decline refund requests where access to content has already been substantially used.

6.3 Subscription Renewal

Where applicable, subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. You are responsible for managing your subscription settings and cancelling prior to renewal if you do not wish to continue.

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection, use, and processing of your information as described in the Privacy Policy. We encourage you to review the Privacy Policy regularly.

We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites. The Platform and all content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. Nibetaus does not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. The educational content provided is intended for general skill development purposes and does not constitute professional advice of any kind.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Nibetaus and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Platform, even if Nibetaus has been advised of the possibility of such damages. Our total liability to you for any claim arising out of these Terms shall not exceed the amount you paid to Nibetaus in the twelve months preceding the event giving rise to the claim.

You agree to indemnify, defend, and hold harmless Nibetaus and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your infringement of any third-party rights.

12. Modifications to the Platform

Nibetaus reserves the right to modify, suspend, or discontinue any part of the Platform at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Platform or any part thereof.

We may update these Terms of Use from time to time. When we do, we will revise the "Last updated" date at the top of this page. We encourage you to review these Terms periodically. Your continued use of the Platform after any changes take effect constitutes your acceptance of the revised Terms.

14. Governing Principles

These Terms are intended to be interpreted in a fair and reasonable manner. Any dispute arising in connection with these Terms shall be resolved through good-faith negotiation in the first instance. If resolution cannot be reached informally, the parties agree to pursue resolution through appropriate legal channels as determined by applicable law.
